1. Acceptance of Terms

By accessing or using InmoImpacto ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time; continued use of the Service after changes constitutes acceptance.

2. Service Description

InmoImpacto is an AI-powered real estate listing generator. The Service allows users to input property information and receive SEO-optimized listing descriptions in Spanish, English, and German. The Service is provided on an "as is" basis.

3. User Obligations

As a user of InmoImpacto, you agree to:

• Provide accurate and truthful property information when generating listings.
• Use the Service only for lawful purposes and in compliance with all applicable laws and regulations.
• Not engage in scraping, automated data extraction, or any activity that places undue burden on our infrastructure.
• Not use the Service to generate misleading, fraudulent, or deceptive listings.
• Not resell, redistribute, or white-label the Service without explicit written permission from InmoImpacto.

4. Account Registration

To use the Service, you must create an account by providing a valid email address and a secure password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account at contacto@inmoimpacto.es.

You must be at least 18 years old to create an account. By registering, you represent and warrant that you meet this age requirement.

5. Credits and Payments

InmoImpacto operates on a credit-based system. Each listing generation consumes one credit from your account balance.

• Free credits: new accounts receive three (3) free credits to try the Service. Free credits have no cash value and are not refundable.
• Credit packs: additional credits can be purchased through our platform via Stripe. Prices are displayed at the time of purchase and are subject to change.
• No refunds on used credits: credits that have been consumed to generate listings are non-refundable. Unused credit packs may be refunded within 14 days of purchase if no credits from that pack have been consumed.
• Credit expiration: purchased credits do not expire as long as your account remains active.

6. Intellectual Property

Your content: you retain full ownership of the property listings generated by the Service based on your inputs. By using the Service, you grant InmoImpacto a limited, non-exclusive license to process and store your content solely for the purpose of providing the Service to you.

Our platform: InmoImpacto retains all rights, title, and interest in and to the Service, including the underlying software, algorithms, user interface design, branding, and all associated intellectual property. These Terms do not grant you any rights to our platform beyond the limited right to use the Service as described herein.

7. AI-Generated Content Disclaimer

The listings generated by InmoImpacto are produced by artificial intelligence and are intended as a drafting assistant. You acknowledge and agree that:

• The Service is a tool to assist with content creation and does not replace professional judgment.
• You are solely responsible for reviewing, verifying, and editing all generated listings before publishing them.
• Generated content may contain errors, omissions, or inaccuracies. You must ensure all listings comply with applicable real estate regulations and advertising standards.

8. Limitation of Liability

To the fullest extent permitted by applicable law:

• InmoImpacto is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• InmoImpacto shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• InmoImpacto's total liability for any claim arising out of or relating to these Terms or the Service shall be limited to the total amount paid by you to InmoImpacto in the twelve (12) months preceding the event giving rise to the claim.
• Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

9. Termination

By you: you may terminate your account at any time by contacting us at contacto@inmoimpacto.es. Upon termination, we will delete your personal data within 30 days in accordance with our Privacy Policy.

By us: we may suspend or terminate your account if you violate these Terms, engage in unlawful activity, or if your account remains inactive for an extended period. We will provide reasonable notice before termination where practicable.

Upon termination, your right to access the Service ceases immediately. Any provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) shall continue to apply.

10. Third-Party Services

The Service integrates with third-party services including OpenAI (for AI text generation), Stripe (for payment processing), and Google Maps (for geocoding). Your use of these third-party services is subject to their respective terms and policies. InmoImpacto is not responsible for the content, functionality, or practices of third-party services.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Spain.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
